Welcome to Confide. These Terms of Service ("Terms") govern your use of the Confide hosted service at useconfide.app. By creating an account or using the service, you agree to these Terms.

The Privacy Bottom Line: Confide is a Zero-Knowledge, end-to-end encrypted (E2EE) platform. We cannot see your data, reset your password, or recover your files. If you lose your keys and your recovery code, your data is gone forever.

1. Eligibility and Service

  • Eligibility: You must be at least 18 years old to use Confide. If you are using the service on behalf of an organization, you represent that you have the authority to bind that entity to these Terms.
  • The Service: Confide provides an E2EE form builder. These terms apply to our hosted service. Our open-source software is governed separately by the AGPL license.

2. Account Security & "Zero-Knowledge"

Confide uses a decentralized security model. You are the sole custodian of your access.

  • Anonymous Authentication: We do not store passwords. You authenticate using passkeys (e.g., FaceID, TouchID, or hardware keys) tied to your physical device.
  • Recovery Codes: Upon registration, you are provided a one-time recovery code. Store this in a secure, physical location.
  • Our Limitation: Because we do not have your encryption keys, we cannot "grant" you access if you are locked out. We recommend adding a secondary backup device to your account settings.
  • Responsibility: You are responsible for all activity under your account. Confide is not liable for data loss resulting from lost devices, compromised passkeys, or lost recovery codes.

3. Privacy and Encryption

  • Encryption by Design: All form schemas and responses are encrypted on your device before they reach our servers. We host the infrastructure; you hold the keys.
  • Security Disclaimer: While we use industry-standard E2EE, no system is 100% secure. Security also depends on your local device integrity. We are not responsible for localized breaches or zero-day exploits on your hardware.
  • Shared Workspaces: Data in Team Workspaces is shared securely between authorized members. Owners/Admins are responsible for managing invitations and access levels.

4. Payments, Plans, and Refunds

  • Billing: Paid subscriptions are processed via Stripe. Upgrading to a paid plan triggers an immediate charge, and your billing cycle begins that day.
  • Usage Limits: Plans have specific limits on workspaces, forms, and monthly responses.
    • Soft Limits: We may allow temporary overages.
    • Hard Limits: Repeated overages will require an upgrade or result in a service restriction.
  • Downgrades/Cancellations: If you downgrade, limits are applied immediately, and non-owner members may lose access to workspaces.
  • Refunds: Payments are generally non-refundable unless required by law.

5. Cancellation and Termination

  • How to Cancel: You must cancel via your Workspace Settings. Deleting a workspace automatically cancels associated subscriptions.
  • Account Deletion: Deleting your account removes all subscriptions and data where you are the sole owner. You will be prompted to transfer ownership of active team workspaces before deletion.
  • Data Retention: Upon deletion, data is removed from active systems immediately. It may persist in encrypted backups for up to 7 days before permanent purging.

6. Rules of the Road (Acceptable Use)

You agree not to use Confide for:

  1. Illegal activities or violating local/international laws.
  2. Phishing, fraud, or the distribution of malware.
  3. Spamming or abusive behavior.
  4. Infringing on the intellectual property of others.

Moderation Note: Because your data is encrypted, we cannot monitor content. However, we reserve the right to suspend accounts based on metadata (usage patterns) or external reports of abuse.

7. Intellectual Property

  • Your Content: You retain full ownership of your data. You grant us a limited license only to store and transmit your encrypted "blobs" as required to provide the service.
  • Our Property: The Confide interface, brand, and trademarks are protected by law. You may not exploit any portion of the service without express permission.
  • Feedback: If you provide suggestions, we may use them without restriction or compensation to you.

8. Limitation of Liability and "As-Is" Service

  • Warranty: Confide is provided "as-is" and "as-available." We do not guarantee uninterrupted or error-free operation.
  • Liability: To the maximum extent permitted by law, Confide LLC and its vendors are not liable for any damages (direct, indirect, or consequential) resulting from:
    • Your use or inability to use the service.
    • Unauthorized access to your data due to local device compromise.
    • Data loss caused by lost encryption keys or recovery codes.

9. Governing Law

These terms are governed by the laws of the United States and the Commonwealth of Virginia. Any disputes shall be resolved exclusively in the courts of Virginia.

10. Modifications

We reserve the right to modify these terms or our pricing. We will provide 30 days' notice for price changes via the dashboard. Continued use of the service after changes constitutes acceptance of the new terms.
